I want to commend the Santa Clarita Gazette for it’s in depth coverage of the Measure US school bond in the Sulphur Springs District.

In reporter Lee Banathan’s article from last week “The Law-Breaking and Rule-Breaking within Measure US,” , Superintendent Kawaguchi failed to directly answer the question about her involvement in authoring and filing the Argument For and Rebuttal to Argument Against.
I do not dispute that the district may engage in filing lawful official documents required to place the measure on the ballot. Section 9 of Resolution No R 19-55 specifies that the Clerk of the Board shall file the Resolution with various government agencies .

The ballot “Argument For” and the “Rebuttal to Argument Against” are not part of the required package for filing. They are not required for the measure to be on the ballot. They are intended to ADVOCATE for the bond measure and include argumentative language.

In an effort to keep a level playing field, Education Code 7054 prohibits the use of district services, facilities , and equipment for ballot measure advocacy. We have no idea who authored or created the language meant to influence the voter. We do know that Superintendent Kawaguchi was the designated filer and contact person for the advocacy document. This is prohibited activity by an employee of the public agency.

Section 11 of the bond resolution, Ballot Arguments reads, “As provided in the Elections Code 9501, any and all members of this Board are hereby authorized to act as an author of any ballot argument prepared in connection with the election , including a rebuttal argument”.

There is not a single name of any Board member , (elected Board members are not considered district employees) on the argument or rebuttal. Why didn’t the Board members fulfill this responsibility ? I can only surmise that it was much easier to ignore the law and just let others do it.

No one will ever know, right?

The voters in Sulphur Springs voters deserve honesty and transparency when placing a bond measure on the ballot. Measure US lacks both.

I urge all voters to vote NO on Measure US, the massive ($78,000,000) bond measure that will increase taxes on all property owners.
